Dance School – giving dance lessons (notification)

General information

Giving dance lessons for ballroom dance and folk dance on a commercial basis requires a notification to the state government. Dance lessons can be given:

  • in permanently established dance schools for an indefinite period of time;
  • temporarily without having a permanent location.

Requirements

The following documents shall be enclosed in the notification:

  • proof of the technical qualification;
  • proof of reliability;
  • information on a suitable location or on suitable premises in which the lessons are to be given.

Deadlines

If the person has given a complete notification pursuant to Sec. 2 of the Oö. Tanzschulgesetz 2010 [Upper Austrian Act on Dance Schools of 2010], they are authorised to give dance lessons in the notified manner.

Procedure

Giving dance lessons for ballroom dance and folk dance on a commercial basis requires a notification to the state government. If the person has given a complete notification, the notifying person is authorised to give dance lessons in the notified manner.

Authentication and signature

No electronic or personal signature of the application is required.

Required documents

  • Official photo ID or, if the main residence is outside of Austria (apart from recognised refugees): passport (or birth certificate + proof of citizenship);
  • Confirmation of at least three years of professional work in a commercially operated dance school;
  • Proof of theoretical and practical knowledge;
  • Extract from the criminal records (or the like) in the country of origin (not older than 3 months);
  • Residence permit (not required for citizens of EEA countries, of Switzerland and for recognised refugees);
  • Certificate of registration in the country of origin (if they have no residence in Austria).

regarding the location:

  • Confirmation of the municipality regarding the room(s) in which the dance lessons are to be given (submit a separate certificate for any room to be added to the list later).

State administrative charge pursuant to the Oö. Landesverwaltungs-Abgabenverordnung 2011 [Upper Austrian Ordinance on Administrative Charges of 2011]:

Fees according to the Gebührengesetz 1957 [Fee Act of 1957]:
Application fee: EUR 14.30;

Further information

The proof of the applicant’s professional qualification shall consist of certificates confirming that the person has exercised the profession for gain for a period of at least three years in a dance school operated on a commercial basis and that they have the theoretical and practical knowledge required to give lessons in ballroom and folk dance. The assessment of such professional knowledge will be made on the basis of an examination that was taken before commissions in other states that were formed on a legal basis and approved to hold dance examinations or based on the successful completion of the training course taken in the professional school of the Verband der Tanzlehrer [Association of Dance Teachers] of Vienna or a comparable course. Certificates on the passed examination correspond to the level of qualification set forth in sub-point i of point b of Article 11 of Directive 2005/36/EC of the European Parliament and the Council of 7 September 2005 on the recognition of professional qualifications, OJ no. L 255 of 30 Sep. 2005, p. 22 as amended by Directive 2013/55/EU of the European Parliament and the Council of 20 November 2013, OJ no. l 354 of 28 Dec. 2013, p. 132.

The state government may grant leniency, based on an application, and waive the requirement of at least three years of professional activity in a dance school operated for gain, if it

  • can be assumed, according to the former activity of the applicant for leniency, that they have the knowledge, abilities and experience required for operating the dance school; and
  • if the applicant for leniency meets the remaining preconditions for giving dance lessons.

Means of redress or appeal

A complaint can be filed against the notification. Such complaint shall be made in writing and must be filed with the authority which issued the notification within four weeks. The period commences upon receipt of the written copy or, in case of an oral announcement, when such is made.

The complaint shall also state the notification and the authority against which it is made, the reasons on which the alleged illegality are based, the request and information that is necessary to assess whether the complaint was filed in due time. Complaints shall no longer be permitted if the party explicitly waived its right to make a complaint after the notification was served or announced to it.

Otherwise, any notification contains information on legal remedies, including the instruction before which authority the legal remedy must be filed and within what period.
